In 2024, an 82-year-old woman died in Arizona after her power was disconnected due to nonpayment on a day in mid-May that reached 99 degrees.
As part of a $7 million settlement stemming from a lawsuit around that case, Arizona Public Service (APS) has agreed not to shut off power due to nonpayment on days that reach 95 degrees or above.

APS’ previous policy was based on a date range—no shutoffs due to nonpayment from June 1 through Oct. 15—but, as we know all too well, parts of Arizona have experienced extreme heat outside of those months.
Last year, there were 430 heat-related deaths in Maricopa County.
What do you think of this new policy? Let me know, and I’ll include some responses in Wednesday’s newsletter!
